Q: Can an employer update its employee handbook without any prior notice to employees?
A: Yes. Employers can update, remove, add or modify policies within their employee handbooks at any time. Each time an update is made, the employer should provide a revised handbook and obtain a new signed receipt and acknowledgment. It is best practice for employers to annually review and update their employee handbooks to ensure compliance with the latest laws, regulations, and best practices.

Existing law, commonly known as the "ABC" test makes it more difficult to classify workers as independent contractors rather than employees. AB 2257, signed by Governor Newsom on September 4, 2020, will add some additional exemptions to the "ABC" test, including exemptions for musicians, writers, and other industries.

*CALIFORNIA EMPLOYMENT LAW UPDATE!*
AB 1947 amends existing labor law, which prohibits discrimination or retaliation against employees who complain about Labor Code violations or other violations of law, to provide for a longer time for employees to report complaints - extending the deadline from 6 months to one year. Any person who believes that they have been discharged or otherwise discriminated against in violation of any law under the jurisdiction of the Labor Commissioner may file a compliant within the division within one year after the occurrence of the violation.
*COVID-19 UPDATE - SB 1159 - WORKERS' COMPENSATION*
Effective immediately, a California employee who tests positive for COVID-19 during an "outbreak" at the employee's "specific place of employment" (not including employee's home) may be awarded workers' compensation benefits, including full hospital, surgical, and medical treatment. Compensation is based on the presumption that the employee contracted COVID-19 at work. It is now the burden of the employer to disprove the claim.
