Many clients are worried about their case because the police report is not accurate or places them at fault. We always inform our clients that police reports are inadmissible hearsay in their accident case. Most of the time, the police officer never witnessed the accident him or herself so how can we rely on the truth of the report?
Police officers take witness statements and make an opinion on the cause of the collision. I have been in numerous cases where incompetent police officers write bad reports or reports that make no sense at all. The only value police reports offer is the alleged statements made by witnesses to the officer. The police report should be looked at as a source of witness information and what witnesses may be expected to testify about. It should never be taken as the truth or fact!
Dont worry if the police report puts you at fault or is inaccurate. It isn't a big deal and the lawyer should take the deposition of all the witnesses to figure out what really happened.
