The U.S. DOL just revised the definition of "health care provider" under the Families First Coronavirus Response Act ("FFCRA") to the limited meaning of that term under the Family Medical Leave Act ("FMLA") (e.g., a doctor authorized to practice medicine, nurse, dentist, etc.). Thus, an employee is no longer exempt from taking paid sick leave under the FFCRA merely because he/she works at a medical facility.

Q: "I cannot work because my child's school "re-opened" virtually and no other suitable person is available to care for my child. I requested leave under the FFCRA to care for my child, but my employer denied that request because my child's school is 'open.' Am I out of luck?"
A: No. If your child's school is only open virtually (meaning that your child is expected to complete his/her work from home), then the child's school is considered "closed" for purposes of the FFCRA. You should renew your leave request. If it's denied, you should contact us.
