A client was driving his mother to work. As soon as he arrived at her place of employment, he noticed his mother's ex-boyfriend waiting outside the building. The ex-boyfriend had been physically abusing her for a long time and had begun stalking her. When his mother walked out of the car she was grabbed violently by the ex-boyfriend. The client jumped out of the car to protect his mother. The ex-boyfriend then picked up a brick and tried to swing it at his head. The client then pulled out a pocket knife that he had in his pocket and stabbed the ex-boyfriend in self defense.
Bloodied and beat up, the client drove straight to our office after the altercation. We advised him that he needed to make a police report and that we accompany him to make sure that the police knew the truth. We further notified the client that representation at the police station would be $400. Reluctantly, he paid it and we went to the police station.
Upon arriving at the police station, officers were waiting to arrest him for felonious assault because they had already received a report from the ex-boyfriend. I immediately intervened and explained to the officers that our client was defending himself and defending his mother from imminent danger. After a back and forth with the officers and their superiors, we were able protect our client from a frivolous arrest. Our client then looked at me and said, "That was the best $400 I've ever spent!"

Male Wanted for Abduction, Aggravated Burglary, kidnapping and Gross Sexual imposition
Police are seeking the public’s help to locate Kevin Ballard, age 27. Ballard is wanted for Abduction, Aggravated Burglary, kidnapping and Gross Sexual imposition for two incidents occurring in tremont today. In the first instance he followed a woman leaving a coffee shop. He grabbed her and attempted to pull her and she threw coffee on him. The male then fled. In the second instance, Ballard approached a woman on a porch and pushed her inside of the residence, strangling her. She screamed and fought him off. He then fled in a vehicle. Further investigation revealed the male’s name. Anyone with information regarding the whereabouts of Kevin Ballard should call 9-1-1.

Imagine being verbally and physically assaulted with racial and bigoted epithets and then having that attacker file a protective order against you.
That’s exactly what happened to my client after she was assaulted for being a Muslim American. She was shoved, scratched and had her hijab (head covering) pulled off her head. To make matters worse she was pregnant at the time of the attack. Her husband hovering between the chaos so he could protect his wife and baby. When she called the police and made a police report, her attacker fled downtown and filed a false protective order. Describing my client as a “terrorist” in her complaint.
Now fast forward to today‘s trial. With evidence illustrating the attacker’s clear islamophobia, bigotry and violence, the case against my client was dismissed. A happy ending to a disturbing story.
