Happy Labor Day
Posts will resume K visa application processing as local conditions and resources allow. Applicants should check the website of their nearest U.S. Embassy or Consulate for updates on what services that post is currently able to offer. The 1-129 Petition for Alien Fiance(e) is typically valid for four months; however, consular officers may revalidate the 1-129 petition in four month increments. For most cases impacted by the suspension of routine visa services or COVID-19 travel restrictions it will not be necessary to file a new 1-129 petition.

Thanks to fearless lawyering, USCIS is now enjoined from imposing changes to the USCIS form fee schedule. The court ruled..
By failing to consider the combined impact of these rules, DHS either failed to consider an important aspect of the problem and disregarded “inconvenient facts” about
the combined impact of these rules.
So, for now, the current USCIS fee schedule is in place. #Immigration

This morning the district court in Cook County, Illinois, et al v. Wolf et. al., (19-cv-6334), granted summary judgment in favor of Plaintiffs on their claim that the Department of Homeland Security’s Public Charge Rule, 84 Fed. Reg. 41,292 (Aug. 14, 2019) violates the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et. seq. The district court specifically ruled that (1) the public charge exceeds DHS’s authority under the public charge provision of the Immigration and Nationality Act (“INA”), 8 U.S.C. § 1182(a)(4)(A); (2) is not in accordance with law; and (3) is arbitrary and capricious. #litigationworks #immigration

Public Service Announcement!
While we are very happy that there may be hope for Comprehensive Immigration Reform, the recent news from the President are just PROPOSALS, they are NOT Law. It is nowhere close to becoming a law. We are hopeful it will become law in the future, but right now, it is not. There are many "experts" and "notarios" who prey on desperate immigrants in order to make a dollar. Trust the Fleischer Law Firm and other leaders in the Immigration Field, like #AILA for truthful and accurate information. ##immigrationreform#immigration
