A different result would have occurred in most states, including South Carolina. For example, if you’ve been convicted of a state drug charge in South Carolina, those same facts can be the basis of a federal prosecution. Prosecution under the same facts in both state and federal courts is not barred by the Double Jeopardy Clause of the U.S. Constitution. In this case however, New York law in effect at the time of Manafort’s actions prohibited the state from pursuing charges under the same facts after the federal government had already done so.

Eugene Jacques Bullard 1895-1961. Born Eugene James Bullard in Columbus, Georgia. After witnessing the near lynching of his father, he ran away to Norfolk, Virginia where he stowed away on a ship to Scotland. Eventually, he lived in France and saw combat after joining the French Foreign Legion when World War I began. He later flew in combat missions with the Lafayette Flying Corps, becoming the first African American fighter pilot. He was a boxer, musician and nightclub owner in Paris during the interwar years. He volunteered to fight again for France during World War II and was wounded before returning to the United States. He received 15 decorations from France and Charles de Gaulle, calling him a “true French hero,” made him a Knight of the Legion of Honor.
