They argue that Illinois high school students are at an extreme disadvantage compared to student-athletes from neighboring states because college coaches will want to see in-game action.

It has ruled that the Illinois General Assembly intended to create an alternative to marriage that was equal in all respects to a marriage. If a child’s parent enters into a civil union with an individual who is not the child’s other parent, that individual becomes the child’s stepparent.

In a follow-up from the October 7 post regarding the challenge to the proposed Illinois "Fair Tax" Amendment, a Cook County judge has rejected the attempt by the Illinois Policy Institute and others of the effort to rewrite Illinois’ tax rules. The plaintiffs were looking to force state officials to tell Illinois voters that the official ballot and a pamphlet purportedly written by state officials to educate voters would actually mislead them into approving the new tax structure.
The plaintiffs had sought a court order directing the Illinois Secretary of State and others to send all voters a “corrective notice,” to allegedly better inform voters on what the "Fair Tax" Amendment actually is and what it would empower the state’s Democrat-dominated government to do.

-LAWSUIT FILED TO DERAIL THE VOTE ON THE ILLINOIS "FAIR TAX" AMENDMENT-
Other than the obvious, one of the big issues facing Illinois voters is the proposed "Fair Tax" Amendment on the ballot. A lawsuit was filed this week in Cook County by the Illinois Policy Institute. The Illinois Policy Institute is an Illinois libertarian non-profit organization that concentrates on education policy, pension policy, and state budget issues.
This lawsuit was filed in an effort to block this amendment to the Illinois Constitution. This proposal (championed by Illinois Governor JB Pritzker) would allow a graduated state income tax. The lawsuit asks the Court to issue corrective notices about the intent of the tax change or to declare the vote on the amendment void.
Illinois voters have already received pamphlets from the Illinois Secretary of State's office explaining the proposed amendment. The lawsuit alleges that the explanation in the pamphlet of the proposed amendment and the arguments in favor thereof are misleading. The IPI alleges that the pamphlet's statements are violative of the Free and Equal Elections Clause of the Illinois Constitution and the 14th Amendment of the US Constitution. They are requesting that the Illinois Secretary of State send out a corrective notice or have the vote on the amendment declared void.
One of the arguments of the IPI is that the pamphlet could induce retirees into voting to impose on themselves a tax on retirement income. They further argue that this proposed progressive income tax amendment would eliminate certain safeguards that would deter the Illinois General Assembly from imposing new taxes on retirement income and from imposing higher taxes on middle and low income individuals. Further, the proposed amendment does NOT give the State authority to ONLY impose higher tax rates on higher earning individuals and lower income tax rates on lower earning individuals, but merely gives the State authority to impose different tax rates on those with different income levels.

~HOMES SOLD AT A RECORD PACE IN SEPTEMBER~
The National Association of Realtors (“NAR”) has recently come out with their September existing-home sales report. It showed that sales of existing, previously owned homes were 20.9% ahead of 2019’s pace. In addition, 71% of homes sold during September were on the market for less than one month, with an all-time low average of 21 days.
The NAR’s chief economist Lawrence Yun said that “home sales traditionally taper off toward the end of the year, but in September they surged beyond what we normally see during this season… I would attribute this jump to record-low interest rates and an abundance of buyers in the marketplace, including buyers of vacation homes given the greater flexibility to work from home.”
This surge in home sales is expected to continue into November with homes selling quickly and at higher prices.

The Village of Orland Park is now among those unwilling to enforce Illinois Governor JB Pritzker's latest restaurant-killing order. Orland Park Mayor Keith Pekau put out a video blasting Pritzker's latest order stating that the goal posts are moving once again while video gaming and casinos stay open. Mayor Pekau also cites a study that less than 2% of all coronavirus cases are caused by indoor restaurant dining. The same study states that about three-quarters of all cases come from nursing home facilities.

~THE FEDERAL ESTATE TAX - WHAT THE BIDEN ADMINISTRATION MAY DO WITH THE EXEMPTION~
In case you were not aware, a new administration will be taking office today. The new Vice President will be the tie-breaking vote in a split US Senate.
The Democrats will be in control of the House of Representatives, the Senate, and the White House. This means that the Biden Tax Plan might pass more easily (remember The Affordable Care Act?). The incoming president has stated, among many other things, that the federal estate tax laws are in for a big change.
The current federal estate and gift tax exemption for individuals is quite high ($11.7 million), meaning that a married couple can pass up to $23.4 million tax-free during life or at death. This estate tax exemption amount has never been this high. Prior to the the passage of the Tax Cuts and Jobs Act on January 1, 2018, the estate tax exemption was $5.49 million. After passage, it jumped to $11.18 million per individual. Now it stands at $11.7 million.
Mr. Biden has indicated his plan to reduce the federal estate tax exemption to “historic” levels.
But what does this mean? Most believe that it will reduce to $5 million per individual or possibly even lower to $3.5 million. That was the amount of the exemption in 2008 just before President Obama first took office. However, in 2001, the exemption was even much lower ($675,000 per individual). A $3.5 million or $5.0 million exemption probably will not affect most people. However, keep in mind that all assets (including life insurance payouts) are includable when determining one’s taxable estate. So many more individuals and families will be subject to this estate tax under the Biden Tax Plan. Also, it is likely that the tax rate will also increase. The current tax rate is 40% on assets in excess of the applicable exemption. Some believe that the new tax rate will be between 45% and 55%.
With this new plan, a larger percentage of Americans will be subject to estate tax. Additionally, there is talk that a Biden administration could push for the tax change to be made retroactive to January 1, 2021.
