Stated differently: Yes, you can sue your employer for post-employment retaliatory actions aimed at dissuading an employee from making a claim of discrimination. In the case cited in this article, an employee who alleged sexual harassment settled with her employer and agreed to resign as part of the settlement. In turn, the employer also agreed not to interfere with any attempts the employee might make to seek employment with other employers, yet the old employer DID. And so the plaintiff sued for retaliation. Thankfully, the federal court recognized the employee's retaliation claim as cognizable. A win for the employee!
