It’s important to make an estate plan and update it every now and then as life changes.
With estate planning, most people know it’s important, but we all get busy and put it on the back burner - until something happens. Sometimes that point will be too late. It's not too late right now!
Estate planning does not have to be morbid, stressful, or sad. In fact, when clients are done, they often say "That wasn't so bad, why did I put it off for so long?" Other clients often say "It feels like a weight lifted off of my shoulders!" Remember: the stress of actually doing your will or trust is FAR LESS than the stress you feel when putting it off!
It's possible for you to plan ahead and save your loved ones the stress. Talk to us at Piatchek Law Firm today. We can be reached at 417-409-2420
It's National Estate Planning Awareness Month!

And remember, we at PIATCHEK LAW are always here to help!

Do you know it is your absolute right to distribute your property according to your wishes?
Most people want to ensure that they pass along assets to the people they care about and want to provide for.
In the US, an individual can leave $11.18 million to heirs and pay no federal estate or gift tax. Married couples get an exclusion for each spouse, so a couple can leave up to $22.36 million to their heirs and IRS won’t collect estate tax on it. Therefore, for most clients, estate tax planning is not necessary, and now is as good a time as ever to create your will or trust.
Claim your right to distribute your property in accordance with your wishes by ensuring you have an up-to-date, quality estate plan. The best way to get started is with a free consultation, contact Piatchek Law Firm at 417-409-2420 today to get started.
What Does A Will Not Do?
A will does not avoid probate! A will actually direct the probate court on how to distribute your assets after you die. However, if you want to avoid the time and expense of probate altogether, you will need to do some additional planning. This additional planning may be as simple as owning property jointly, or having a Transfer on Death (TOD) or Payable on Death (TOD) designation placed on financial accounts and vehicles, or many clients benefit greatly from setting up a trust to avoid probate.

Why Do I Need An Estate Plan?
Most people assume that the laws of their state will appropriately distribute their property to family members. That is true to a certain extent, however, you give up a lot of rights if you fail to plan. For Instance, if you plan in writing, you can select who you want in charge, exactly how you want that person to handle various situations, say when and how you would like beneficiaries to receive their share, and in the process, you can prevent disputes and reduce stress for your family - during what could be a very difficult time.
An experienced Estate Planning Attorney can advice you on how best to structure your assets, including financial accounts, businesses, insurance policies, and real estate. For a confidential, no-obligation consultation contact Piatchek Law Firm at 417-409-2420

Procrastination is the biggest enemy of estate planning. While none of us likes to think about dying, improper planning or no planning can lead to family disputes, assets going into the wrong hands, lengthy litigation, and excess attorney fees. So pick a time to get started.
To quote Benjamin Franklin, “By failing to prepare, you are preparing to fail.”
Don't put it off any longer! Please call PIATCHEK LAW at 417-409-2420 to get started.
There's more to estate planning than simply writing a will. Accounting for all of your assets and wishes will ensure your plan is executed smoothly after your death.
Keeping written lists (and informing your estate administrator of the location of those lists) will help ensure that no assets or wishes get left out.
By designating beneficiaries on retirement accounts and completing the transfer on death designations on other accounts, you can keep those assets from passing through probate under a Last Will and Testament.
What do you know about Asset Protection?
Asset protection is the concept of guarding one's wealth using legal strategies. A component of financial planning intended to protect one's assets from creditor claims. Individuals and business entities use asset protection techniques to limit creditors' access to certain valuable assets while operating within the bounds of debtor-creditor law.
Asset protection helps insulate assets in a legal manner without engaging in the illegal practices of concealment, contempt, fraudulent transfer.

DID YOU KNOW?
Living wills, which allow people to control their end-of-life medical decisions, are a recent estate planning mechanism.
California became the first state to allow living wills in September 1976. It has since been legal in other states, and has become one of the most important concepts in one's estate plan.

Importance of Asset Protection
The goal of a comprehensive asset-protection plan is to prevent or significantly reduce risk by insulating your business and personal assets from the claims of creditors, or future lawsuits.
Unfortunately, many small-business owners are unaware of all the potential risks that can harm their business, as well as the full spectrum of protections that may be available.
An asset-protection plan employs legal strategies to guard your assets and your future. If any of this seems of interest or importance to you, then call us.

Asset Protection and Real Estate
Jointly-held property owned by "Husband and Wife" (legally referred to as "tenants by entirety") can be a very effective, and often underrated form of asset protection.
When a Husband and Wife own property as tenants by entirety, each spouse owns "the whole thing", with there being two owners - the Husband owns the whole thing, and the Wife owns the whole things. If a couple owns property this way, the result is that creditors having a claim or judgment against only one spouse cannot attach the property owned by both spouses - because the other spouse also owns "the whole thing". This form of asset protection can be very simple and effective, especially when combined with other more comprehensive strategies.

If a debtor has few assets, bankruptcy may be considered the more favorable route compared to establishing a plan for asset protection. If significant assets are involved, however, a proactive asset protection plan is advised, and it needs to be established before a problem or lawsuit comes up is Certain assets, such as retirement plans, may be exempt from creditors.

Effective asset protection begins before a claim or liability arises. It is usually too late to protect assets in any worthwhile or meaningful way once a problem has already occurred. Asset Protection consists of mostly preventative measures, not after the fact "cures". Some effective methods for asset protection include Limited Liability Companies, irrevocable asset protection trusts, and may even involve joint titling of property,.
An experienced Asset Protection Attorney can advise you on how best to protect your assets, including real estate, financial accounts, vehicles, and businesses.

Bad things can happen to good people. Lawsuits can be filed against good people and responsible businesses. Life happens.
If your industry carries some level of risk, you should think about asset protection to protect your family's future in the event you were ever sued. Once a situation arises, it is often too late to create an asset protection plan - it must be done as a preventative measure, in advance. .

WHAT ASSETS CAUSE RISK?
There are safe assets and there are some so-called dangerous assets, that by their very nature, can create substantial risk of liability. Asset that bring risk with them may include rental real estate, commercial property, business assets, such as tools and equipment, and motor vehicles. Safe assets, on the other hand, do not promote a high degree of inherent liability.
Safe assets can generally be owned by you individually or by the same entity since they carry with them a low probability of risk.
However, you do not want to commingle dangerous assets either with other dangerous assets or with safe assets. Keeping ownership of dangerous assets separate limits exposure of loss to the individual asset.
Protect your assets today. Call PIATCHEK LAW at 417-409-2420 to get started.

How Can Internal and External Claims Affect Your Assets?
Internal claims arise from creditors whose remedy is limited to assets of a particular entity, such as a corporation. An example is if you have a corporation that owns a piece of real estate and someone slips and falls on the property owned by the corporation, the injured party may often be limited to pursuing the corporation's assets (i.e., the real estate). This assumes you did not personally cause the injury.
External claims are not limited to the assets of the entity and may extend to your personal assets. For instance, if the same corporation owned a truck that was negligently driven into a crowd of pedestrians, the injured could not only sue the corporation but also the driver, and may be able to satisfy any judgment from corporate assets, or the driver's personal assets.
If you have questions about how to best structure your personal and business assets, please contact Piatchek Law Firm at 417-409-2420 today
If you are vulnerable to a frivolous lawsuit, use and understand the protection you already have, then add legal tools in an integrated approach after seeking legal advice. More sophisticated strategies may include Irrevocable Trusts that work with your existing business entities.
ACT NOW, BEFORE a legal crisis occurs. Asset Protection is difficult after a lawsuit has started, and you do not want to be guilty of “Fraudulent Transfer” or “Voidable Transfer” where it appears that you are hiding assets after being sued. Not only will you likely be forced to undo all of your asset transfers, but other complications can arise
Be realistic about the risks you face. Keep in mind how losing a lawsuit might affect your lifestyle, family, and posterity. Taking a comprehensive approach to Asset Protection will allow you to sleep better at night!

No one likes getting a traffic ticket. Some folks, especially those who can easily afford to pay, may roll their eyes and pay the ticket even if they believe it was wrongly issued. Others may challenge their ticket and get it dismissed, or negotiate the ticket down to a lesser offense.
Of course, some people ignore their tickets altogether. They might think that nothing bad will happen or that they will take care of it later. Think twice before you ignore traffic tickets, though. The consequences can be severe.
#springfieldmo #springfieldmissouri
It is December finally – the month of holiday parties! Enjoy yourself but be safe and avoid those traffic tickets!
Avoid speeding, avoid using your cell phone while driving, and don't be careless! Carry your license and insurance in your car, and never be under the influence of alcohol or drugs while driving.
Stop at stop signs, red lights, and never leave the scene after an accident. A little care helps not just avoiding traffic tickets but ensures safety for all as well!
#springfieldmo #springfieldmissouri
Missouri law is very specific and complex concerning driving while intoxicated
(DWI) and driving under the influence (DUI) offenses.
The punishments can be severe and may affect the defendants for the rest of their lives. The consequences are many, including fines, a suspended license, court appearances, arrests, prison and/or probation. You need a solid defense in place if your case leads to the courtroom.
#springfieldmo #springfieldmissouri
If you hire an attorney and are proactive regarding your traffic ticket, you may be able to receive a reduced sentence, reduced fine, receive a suspended imposition of sentence, or have all charges dropped, or complete traffic school in lieu of other penalties. You can also challenge the ticket if it makes sense to do so. Your flexibility in defense goes down significantly if you ignore tickets, and the deadline to do something about them passes.
Accumulate enough points in a certain period, and you could have your license suspended. When you ignore traffic tickets, that act itself can add more points to your record.
#springfieldmo #springfieldmissouri
Refusing the breathalyzer test may result in an immediate arrest and revocation of the defendant’s driver's license. If you are sober, it's often best to test, but there are exceptions - and every case is different.
When your case comes to court and the officer states that you refused the test, the judge may assume that you did not take the test because you thought you would fail it. However, is this presumption better or worse than an actual failed test? But what if you would have passed the test?
There are many other circumstances that can figure into your case. This is why it is best not to drink and drive. However, if you need assistance or have questions, we are here to help!

You may be tempted to simply pay your traffic ticket and move on, but first, consider that:
o This ticket will likely appear on your driving record.
o You will probably get points added to your license. Too many points could cause your license to be suspended.
o Your insurance company will likely raise your car insurance rates a significant amount, typically for three years.
Our attorneys can usually help you avoid some or all of the above, and often the price we charge is less than what you will pay in increased insurance premiums.
Call us today at 417-882-5858 and see how we can help.

Don’t let that “one mistake” affect the rest of your life.
Although attorneys cannot change what has already happened, they will fight to ensure the best possible future for you, protecting your rights and negotiating a positive outcome that allows for a second chance.
DWI laws are complex inside the courtroom, and our attorneys are experienced and can help you understand the proceedings, and try to get the best outcome. Everyone makes mistakes, and we will try our best to help you. Please call us at 417-882-5858.
#springfieldmo #springfieldmissouri
Everyone hates traffic tickets. And when you receive one, you probably wish you could forget about it. But before you throw the ticket in your glove box and forget about it, you need to make sure you take care of business to avoid the unwanted consequences that come from unpaid traffic tickets.
Avoiding jail time or being arrested is one thing, but failure to pay a ticket could also result in:
• Suspended driver’s license
• Ineligible to renew your driver’s license
• Ineligible to register your vehicle
• Vehicle being towed and impounded
• Increased insurance premiums

From your friends at,
The Piatchek Law Firm, LLC
Have you experienced that gut-wrenching feeling in the pit of your stomach, when you first notice a bright flash of police lights as they appear in your rear-view mirror? "I hope they're after someone in front of me," you mutter.
However, you realize that they are after you. Maybe you know exactly why you're being pulled over, or perhaps you have no idea. As you pull over to the side of the road, and each second feels like an hour, as you wait for the officer to approach.
Please be careful out there this holiday season! If you have the displeasure of experiencing the above, please contact our office if we can help you.

Are all your family, business, and personal affairs in order?
It's that time of year when we are all thinking of our families, and hopefully getting to spend some time with them (though this year may have its challenges). This is also the time of year we all start thinking about the new year to come.
What do you want to accomplish next year in your family, business, or personal life? We are here to help!
Every year more than 41 millions Americans earn themselves a speeding ticket.
It usually happens when you least expect it. Maybe you’re a little late for a party or that special date, but for whatever reason, you're going a little faster than expected — boom, Speedtrap.
Missouri Speeding Ticket Fines are sometimes tricky to figure out because fines can vary depending on what city or county you received the ticket, how fast you were going, or whether you were speeding in a construction/work zone. If you are going really fast, you may even end up in jail, or may likely have a court appearance. Please let us know if you would like our assistance.
#springfieldmo #springfieldmissouri
Let’s dive into the DWI laws in Missouri.
By law, it is illegal to operate a motorized vehicle while intoxicated or under the influence of legal or illicit drugs. The old cliche “don’t drink and drive” becomes much more complicated once you are arrested or charged with a DWI.
What exactly does it mean to be “operating” a vehicle? What is and is not considered a “motorized” vehicle? What does the court consider "intoxicated" or one being in a “drugged state?” These are all relevant questions and can vary from one situation to the next.
The punishments for a DWI/DUI conviction are contingent upon a host of variables, including prior criminal convictions, where you were arrested, and not uncommonly, how good your attorney is.
#springfieldmo #springfieldmissouri
When you borrow a friend’s car, maybe out of necessity, or perhaps out of convenience, you should check a few things.
Make sure you have proof that the car is insured, in case you are pulled over by a police officer for a traffic violation. Even though the vehicle may be insured, if you can’t find the insurance card at the time of the traffic stop, you may receive a ticket for “No Insurance,” or “No Proof of Insurance", or something similar. If you are insured, perhaps your insurance will cover this situation - either way, it is a good idea to know what your policy does cover, and what it does not.
You should always be careful when driving, but especially when the car is not yours! If you have any traffic concerns, please contact us anytime.

Divorce filings tend to peak following winter and summer holidays. There are several reasons why this may occur. Winter holidays are culturally sacred times; Who wants to think about divorce at Christmas?
On the other hand, holidays are also a time of increased stressors that can contribute to the dissolution of some marriages over those periods. So holidays may be a time of pent-up demand for divorce that gets released in the subsequent months as spouses file their paperwork to split up.
Whatever the reason, if you find yourself in a situation where divorce is your best option, the Piatchek Law Firm is here to help you through this potentially difficult time.
#springfieldmo #springfieldmissouri
If you are considering a divorce and your spouse will not cooperate, your case is likely “contested.” Most divorce cases are contested; contested divorce is the norm. If you are not sure whether your case is contested or not, you can presume you have a contested case.
Sometimes you have to fight for what is important to you in life. We strive to help clients with all types of family law issues, including the following:
💠Contested Divorce
💠Contested Modifications
💠Child Custody and Support
💠Cooperative, Uncontested Divorce

There are many ways to handle a divorce, including an “uncontested divorce.” There are also many different terms that people use to describe “uncontested divorce,” such as:
✴️ Cooperative Divorce
✴️ No-Fault Divorce
✴️ No-Contest Divorce
✴️ Agreed Divorce
✴️ Agreed-to Divorce
✴️ Collaborative Divorce
✴️ Quiet Divorce
✴️ Quickie Divorce
✴️ Simple Divorce
✴️ Cheap Divorce
✴️ Cooperative Divorce
Do all of these terms refer to the same thing? Generally, yes. To be honest, we don’t really care for the term “uncontested divorce,” as it is a bit misleading. We think it is much more accurate to call it a “cooperative divorce.”

But all in all, I was MORE than pleased, and I have recommended them time and again."

I separated from my spouse years ago, and now I don’t know where he/she lives. How can I get a divorce?
A divorce by publication is an alternative to a standard divorce or an uncontested divorce. It is used when the person you are trying to divorce cannot be found or located. So rather than have them cooperatively sign papers or serve divorce papers on them, the party petitioning for a divorce is required instead to insert a legal notice in a local publication multiple times, informing the public of the divorce.
This type of divorce should only be used when you have made good faith attempts to find the person, and you simply cannot locate them. A divorce by publication should not be used when you can locate the person or you do know where they are, but you simply do not want to talk to them.

We are often asked if individuals are required to have an attorney to divorce, especially in cooperative or uncontested cases. Certainly, if you are a legally oriented person who understands legal documents, and you have a lot of time on your hands, you may be able to research, understand, and handle an uncontested divorce by yourself.
However, uncontested divorces can still be quite complicated. Even the most simple divorces require many forms that must be completed correctly, and these forms may affect your rights for a very long time.
In our experience, attempting to do it yourself will cost you more money in the long run,

“Great group! From a legal standpoint, they did what I asked them to do but that's not what gives them a 5-star review. Any lawyer can do stuff. No...what makes them great is they listened. They understood what was important to me and they did what they could to honor those needs. “

Real Estate Tax Foreclosures
If you do not pay your county real estate taxes, the Missouri county in which the real estate is located can foreclose against your home by forcing a tax foreclosure sale.
If the county forecloses on your home they may eventually sell your home at auction to the highest bidder, and this new owner may eventually have the right to remove you from the property.
It’s imperative that you pay your real estate taxes. If you are in danger of being foreclosed on by the county you need to take action immediately.
The assistance of an attorney can greatly increase your chances of getting your home back. To get started, call the Piatchek Law Firm today at 417-242-4775.

Right now, there are more people behind bars for drug offenses than ALL the people in prison for any crime in 1980.
This increase in incarceration happened partly as a result of the "tough on crime" era. For example, since the official beginning of the War on Drugs in the 1980s, the number of people incarcerated for drug offenses in the U.S. skyrocketed from 40,900 in 1980 to 452,964 in 2017.
In Missouri, a conviction for drug trafficking or another drug-related crime can result in life-altering penalties for the defendant. Anyone facing such charges must seek out the best defense they can find.
At the Piatchek Law Firm, our attorneys have the knowledge and know-how necessary to advise clients facing pressure from law enforcement.
Everyone deserves a drug defense attorney that will protect their rights and offer them the best chance at a bright future.

Here's an unhappy fact: The United States is the world's leader in incarceration.
Currently, 2.2 million people reside in our prisons and jails. That's a 500% increase over the last 40 years.
The biggest reason for these increases changes to law and policy, not changes in crime rates. The results are overcrowding in prisons and fiscal burdens on states.
If you've been charged with a crime in Missouri, don't become another statistic. Contact our office to talk to one of our experienced criminal defense attorneys. We can help you consider all your options and fight for the best possible outcome.

Have you recently received a traffic ticket or received a citation for a moving violation?
Whatever you do, please don't put the ticket in your glove box and forget about it. The worst thing you can do is to do nothing! Ignoring a traffic ticket could result in extra fines, court costs, warrants issued for your arrest, or even jail time.
At the Piatchek Law Firm, our attorneys regularly handle traffic matters and fix traffic tickets. We will attempt to keep your moving violation off your record or (at a minimum) attempt to reduce or eliminate the points added to your driving record. We can also attempt to minimize the impact the violation will have on your insurance rates.
