Sometimes the drivers who cause accidents and are clearly responsible for causing the accident do the right thing--they admit fault, and say "sorry". Yet some of the insurance companies that are supposed to protect the responsible drivers often ignore their insured drivers and come up with silly arguments. We recently deposed a nice young man who struck our client because the sunlight blinded his vision. He immediately apologized, called 911, visited our client in the hospital, and called to check on our client as her broken leg healed. That young man is an example of a good person who caused an accident and then wanted to do the right thing. Yet even though this young man wanted to take responsibility for our client's broken leg and told his insurance company that he was at fault, his insurance company didn't let him and forced him into litigation. When we deposed him--which we didn't want to do but were forced to because of his insurance company's actions--he had this to say: 1 A. Yes. 2 Q. Is there anything you want to say to my 3 clients? 4 A. I'm sorry and I wish this never happened. But it was my fault. 5. Q. If it was your fault, why do you think we are sitting here today? 6. A. Because my insurance company is the worst. They are terrible. They are terrible. I hit her and my insurance company should pay. They should not be making her or me sit through this and go to trial. I've heard stories about how bad they are and now I am living proof of just how bad an insurance company they are. Why are they trying to say her broken leg isn't that bad and that her medical bills are too high? I feel bad for her and for me. We're here because my insurance company is doing this. We're not going to say the name of this particular insurance company, but suffice to say you're definitely never in good hands with this carrier. We'll let you know how the trial goes in 2021...
A little Monday morning “welcome to another week of 2020” humor...
Sports during the virus? Yes according to Georgia Senate Bill 359 which says that schools are protected from liability if kids contract the virus while playing sport so long as the school follows reasonable safety protocols. That means schools can allow their students to play sports without the school having to worry about facing a lawsuit if a student gets sick. Bill 359, which was passed and signed into law in July, protects against liability unless there is evidence of “gross negligence, willful and wanton misconduct, reckless infliction of harm, or intentional infliction of harm in an action involving a COVID-19 liability claim.”

It took over a year and a half, but yesterday gave tremendous closure for a deserving lady. Our firm successfully resolved a tough premises liability/back surgery case yesterday at what was our first in-person mediation since February 2020 when the pandemic struck. A lot of credit has to go to the gifted (an older, wiser, and seasoned) trial lawyer-turned-mediator who travelled from Birmingham, AL to Atlanta just to mediate the case. This case involved multiple defendants--none of whom wanted to take full responsibility for our client's broken back and $350,000 in medical bills--plus the law was complex. Alabama's laws are vastly different to Georgia's laws in terms of "apportionment" in GA versus "joint and several liability" in AL, as well as "modified comparative negligence" in GA versus "contributory negligence" in AL. It took all day, but the mask-wearing, elbow-greeting, socially-distanced in-person mediation was all worth it when at the end of the day this awesome client smiled and said she can close this chapter of her life. She is WALKING forward physically and emotionally healed, and extremely financially secure. During one of the many lulls as we waited in our room, I complimented her on the bracelets she was wearing. She smiled and explained that during the time she was at home recovering from her surgeries, she had started a small business making bracelets which she sells to churches and friends. Before I knew it, she had plucked a bracelet off of her wrist--it was cool and had tiger's eye stone--and slid it across the table telling me I should wear it as a gift from her in recognition of the work our team had done on her behalf. THAT was the highlight of the day. 404-JUSTICE may be expanding into 205-JUSTICE!
