Michigan dog bite injury laws & owner liability rules: In Michigan, dog 🐶 bites law are found in MCLA 287.351 which states that in order to prove that a dog owner is liable, the person bitten must show that: 1. The injury was caused by a dog bite. 2. The person bitten did not provoke the dog (The old adage is do not kick a sleeping dog) 3. The person was in a public place, or was lawfully in a private place when the bite occurred. The deadline or statute of limitations is 3 years from the dog bite to file suit. The 2 defenses to a dog bite claim are provocation and trespassing. Any dog owner should verify in writing that they have coverage under their homeowner's insurance policy. Trust v will? Both a will and a living trust are important because they both say who your heirs will be that will inherit your property upon your death, and they both say who will be in charge of carrying out your written instructions. But a will is not recognized as a legal entity. Only a trust is recognized as a legal entity, and a trust can even get a tax ID number from the IRS, while a will can not. Therefore you can fund a trust by putting your real estate or bank accounts or investment accounts into the name of your trust, and thereby avoid probate of those assets. Only a trust can be the owner of your assets, not a will, and thereby avoid probate. That is why a will is better than no document, but a trust is better than a will.
Expungement info: Did you know that since January of 2015 in Michigan the law was updated so that it is now easier to set aside certain types of convictions? In fact, now you can erase either 2 misdemeanors or 1 felony, as long as you do not have more than 2 misdemeanor convictions. Convictions are only eligible to be set aside after a 5 year period, and not all convictions are eligible to be set aside.
