Court News and Updates!!!!!!!!!!! You may or may not know that the TN Supreme Court has cancelled Court for all litigants unless you are incarcerated or fall under a narrowly defined exception until March 31, 2021. This means the Civil and Criminal Court dockets will be slammed with cases once Courts resume. The 16th Judicial District received special permission from the TN Supreme Court to hold 3 separate Grand Juries during the month of February. This will alleviate a backlog of criminal cases that were waiting presentment to the Grand Jury since December. This will also create an increase of cases in Circuit Criminal Court when it resumes in April. To say this summer will be busy is an understatement, but we are thankful to have the ability to represent our clients during this strange time. Good News.....the 16th Judicial District, including the Town of Smyrna General Sessions Court, are implementing ways in which to resolve Criminal cases virtually between now and March 31st. This is a great way to conclude cases and will also keep litigants from having to come to Court when it resumes the first part of April because their case would have been entered by the Court. Feel free to give us a call for a free consultation on your case. During the call, we will assess your case and provide you with needed information so you can make an informed decision if retaining our firm would be a good decision. 615-890-7365
Court Update as of 2/12/21 The TN Supreme Court issued a new Order addressing the reopening of Court and certain cases. The Order states in pertinent part as follows: (1) Lifts the suspension of in-person court proceedings in termination of parental rights cases on Monday, March 1, 2021; (2) Lifts the suspension of all other non-jury in-person court proceedings in all state and local courts in Tennessee, including but not limited to municipal, juvenile, general sessions, trial, and appellate courts on Monday, March 15, 2021; and (3) Preserves the suspension of all jury trials through the close of business on Wednesday, March 31, 2021, subject only to exceptions that may be granted by the Chief Justice on a case-by-case basis. Face coverings continue to be required, and attorneys, litigants, and others should familiarize themselves with the Order's quarantine requirements in cases of exposure or a positive test. Even with the easing of restrictions, the Court still encourages courts to hold virtual proceedings whenever practical.
