#TBT to this Monday when Billy Wieland, joined by fellow Orlando attorney Jacob V Stuart Jr., prevailed in their case against Governor Ron DeSantis, Education Commissioner Richard Corcoran, and other officials with the State Florida. Their case was brought on behalf of local teachers and a mother regarding the arbitrary August 31, 2020 deadline set by the State of Florida to open schools or lose funding. Billy and Jacob’s case was a grassroots case brought by a teacher and concerned parent and was the first of it’s kind filed in the State of Florida. The Judge eventually Ordered their case to be consolidated with another similar case filed later.
Last week, Billy and Jacob argued the case to Judge Dodson in Tallahassee via Zoom Video Conference (as required by the 2nd Circuit Court), putting on witnesses, including expert witnesses. Their clients also offered testimony about being forced back into the classroom against their will. Evidence and testimony was even presented of a quadriplegic teacher who was forced back to school to teach live face-to-face instruction despite being told by his physician if he contracts COVID-19 he is unlikely to survive. On Friday, Billy delivered closing statements in the case arguing for his clients that forcing schools to reopen based upon budget threats and an arbitrary deadline of August 31, 2020, without proper local control, was certain to lead to devastating health consequences for our entire State. Judge Dodson agreed, ruling portions of the Emergency Order unconstitutional, and returned the power to decide when it is safe to open schools to the local school boards.
The case garnered both local and national media attention.
