But an immunity passport raises a number of questions here in the U.S., not the least of which is whether the practice would violate rubrics associated with the Americans with Disabilities Act, the Rehabilitation Act or other Equal Employment Opportunity laws.

Rick Marchese of our Elder Law Practice Group provided an update on the latest information regarding the new lookback provisions for community based long term care. The State Department of Health ("DOH") has yet to issue any policy directives on this important new development in Medicaid eligibility, but, from his conversations with counsel for the DOH, we have been able to learn a few important bits of information. The new transfer penalty provisions impose a thirty (30) month lookback for any and all transfers of assets made after October 1st, 2020 by individuals applying for community base long term care services ("CBLTC"). These new lookback provisions will be implemented as of April 1st, 2021. Please note that applications for TBI or NHTD waivered services are exempt from these new transfer provisions.
