Another PSA:
When an officer ask to search your vehicle you can, and should, just say no. (Unless you are on parole or probation).
I know, most of you are thinking, "but they would never find anything illegal in my vehicle." Are you sure? When was the last time you had your oil changed? Did a grandkid borrow your car a few weeks ago? How do you know they did not accidentally drop a hydrocodone pill under your seat? For that matter, if you bought it used, who knows what the previous owner dropped under the seat.
If you grant permission to search, the police will find anything that is illegal. At that point, you face a new challenge. "It's not mine", "I did not know that was there" and "this is not my car" do not get you off the hook.
You see, in Arkansas at least, there is an implication that contraband found in a place immediately and exclusively in your control is "constructively possessed" by you.
So if an officer ask to search your vehicle, just say no. They may search it anyway, but you are under no obligation to consent.

Effective January 12, 2021, I will no longer be accepting criminal defense cases. This is because I have accepted an appointment to serve as a Deputy Prosecuting Attorney in Mississippi County. I am very excited to serve in this capacity.
This position is part time and will not interfere with my private practice. I will continue to accept cases involving inheritance disputes, probate of estates, personal injury, accidents, wills, trust and estate planning and divorce cases not involving custody issues.
