Nice to have three floors in the office where the attorneys and parties gets their own floor each for Zoom depositions. Car accident case where the traffic control device was not working due to a storm, and both cars t-boned each other in the intersection.
Here is hoping some of the new normal stays. Had a 30 minute hearing four hours away from my house today. The hearing started at 11:05. It was done by 11:35. Much better! Let’s keep what makes sense, and let’s get rid of what never did!
Just like there are good doctors and bad doctors, good cops and bad cops, there are good lawyers and bad lawyers. Mailed a settlement check today to a client where his lawyer failed to timely file his Worker’s Compensation claim in the correct state. I have handled over 50 legal malpractice claims in the past 20 years, and most of the cases deal with lawyers not doing what they are required to do by a certain deadline. Failing to file the Worker’s Compensation claim in Tennessee by the one year deadline, (he filed about a month later after it had been dismissed in Kentucky), resulted in the negligent lawyer’s insurance carrier paying $175,000.
Had a thirty minute 9:00 a.m. Zoom Hearing on the other side of the state this morning and a one hour telephonic Hearing this afternoon in Louisville. Another Judge handled issues in a case yesterday via email. Thankful for Judges that keep cases moving towards a conclusion, are not afraid to vary from old methods and use novel approaches, and resolve these issues in a safe and efficient manner!
I can’t begin to count the ways a thirty minute 9:30 a.m. Zoom hearing on a case nearly four hours away in Whitesburg, Kentucky is better than driving eight hours to accomplish the same thing. Here’s to hoping some of the new “normal” continues!
Closed on the sale of my law office building today. Was a little bittersweet as so many good memories over the past eight years. I had really made the space my own and was proud of it. Thankful for a great tenant, Stack Insurance, and the best commercial realtor in the city, Gant Hill, who found the space for me in 2013 and also placed us in the penthouse suite of The Republic Building way back in 2004. Only the mailing address changes - all other contact, telephone, fax, email, website, remains the same. One chapter ends, and a new one begins!

If you are a “glass half-full” kind of person, one of the best things to come out of the pandemic is Zoom. This time one year ago, today’s deposition likely would’ve been canceled due to the weather, postponed for a couple months, further delaying resolution of this clear liability auto accident case. If you looking to buy, Zoom stock is down 4% today...As an aside, check out the lamp in defense counsel’s background. Everyone had one in college at UK, but I haven’t seen one in real life in 25 years!
