Tomorrow morning - 9.23.20 - at 9AM I will testify before the PA House Veterans Affairs and Emergency Preparedness Committee on the Subject of Governor Wolf’s Emergency Powers under Title 35 (Health & Safety). I will inform the Committee on the status of our lawsuits against the Governor challenging his statutory authority for the Business Closure and Stay At Home Orders and will provide my recommendations on how the Emergency Management Services Code can be amended to prevent what this Governor has done to us from ever happening again. #ReOpenPA
Some of you have asked about the breakdown of the Third Circuit Court of Appeals, as it will soon receive and decide a Motion for Stay to be filed by the Gov in the County of Butler v. Wolf case and the appeal. Of the 14 sitting (non-senior) judges here is the breakdown by presidential appointment: Clinton appointed 2, GW Bush appointed 4, Obama appointed 4 and Trump appointed 4. So it is 8 Republicans to 6 Democrats. But, you never know. Judges are hard to predict. #ReOpenPA
This just in from the great Attorney Tom King: Judge Stickman denied the Governor's Stay Request in County of Butler v. Wolf - thus the congregate gathering limits (25 people indoors and 250 outdoors), the Stay At Home Order and the Business Closure Order remain DEAD (for now)! Judge Stickman issued a blistering decision lambasting the Gov for not bothering to develop the record in court and instead for citing to newspaper articles. That's because the Gov has no proof to support his Orders. Where's the science? There is none. The Judge ruled: (1) the Gov did not establish "even the minimal showing of success on the merits of his case" in support of its congregate gathering limits; (2) the Gov will not be irreparably harmed if the Judge's order remains in effect because the Gov failed to prove, despite ample opportunity, that people will be harmed by the lifting of the congregate limits. The Judge reminded the Gov that he provided no proof to support his wild claims that the protests -- that spread thru the Commonwealth this spring and summer-- resulted in super-spreading of COVID-19 and the Judge pointed out that Governor Wolf himself was obviously not worried about super-spreading because he attended a protest in defiance of his Stay At Home and congregate gathering limitations! (Basically, the Judge points out the Gov is a fraud); (3), the Judge, even though he didn't have to consider factors (3) and (4), considered them anyway and held, (3) the issuance of the stay would substantially harm the people of Pennsylvania because the Gov could re-impose his "novel and draconian restrictions on the people of Pennsylvania"; and (4) "The public has an interest in constitutional governance and, more specifically, not being subject to unconstitutional government action," that, "The Constitution is the law of the land and protects the rights of all citizens," and "The public interest would be ill served if the Court would grant a stay allowing the unconstitutional measures to remain in place." Brutal and beautiful. Long live Judge Stickman! Thank you President Trump for putting him on the bench! Now, the Gov will likely file a request for a stay in the Third Circuit Court of Appeals, which is where this case will now continue. Stay tuned.

Regrettably, today, a three judge panel of the Third Circuit Court of Appeals - Chief Judge Smith and Judges Chagares and Shwartz - granted the Governor's Motion to Stay Judge Stickman's Order. Thus, the congregate limits of no more than 25 persons indoors and no more than 250 person outdoors are once again the law of the land. Further, the Governor can reinstitute his Business Closure and Stay-At-Home Orders.
Another Successful Expungement of a Mental Health Commitment! Congratulations to Scaringi Law Attorneys Brian C. Caffrey and Robert M. Sakovich for another successful expungement of an involuntary mental health commitment under Section 302 of the Mental Health Procedures Act. This time Scaringi Law litigated in the Philadelphia Court of Common Pleas. We brought suit because, among other reasons, our client was involuntarily committed without an arrest warrant and without being informed of her rights. The Judge agreed that this commitment violated the Mental Health Procedures Act and our client’s procedural due process rights guaranteed by the Pennsylvania and United States Constitutions. Our client’s right to her reputation and her right to keep and bear arms guaranteed by the 2nd Amendment have now been restored. BREITBART.COM Dershowitz: Trump Has 'Two or Three Legal Constitutional Paths' -- 'I Don't Think that the Election Is Going to Be Reversed' Marc A. Scaringi Today at 2:29 AM · Breitbart - Mobile Web · Renowned constitutional lawyer and scholar, Alan Dershowitz, has announced that, “In the Pennsylvania cases, they [Trump lawyers] have two very strong legal arguments” and that our Equal Protection Clause claim is a “winning issue in the US Supreme Court.” Yes, we must produce the evidence. No doubt. That’s why today we filed a Notice of Appeal in the 3rd Circuit Court of Appeals. We’re asking that Court to reverse the District Court’s denial of our Motion for Leave to File a Second Amended Complaint, to direct the trial court to decide the issue on its merits, to decide our motions for discovery and to proceed expeditiously to a hearing to enjoin certification of the results of the Presidential Election. I’ve received a tremendous amount of criticism personally and professionally, including threats against my law license and my law firm, for taking on this case. But we do have strong legal arguments, according to one of the top constitutional scholars in the world. Yes, I was skeptical too at first. But then I studied the law even more closely, read the pleadings and the many affidavits and declarations from the witnesses and became convinced in the merits of the case. So to our critics and antagonists from around the world, please take a pause, take a deep breath and let the judicial system work. Give us a chance to put in the evidence and have our day in Court. And then let the Courts decide based upon the facts and the law. Our Constitutional Republic is worth it.
This evening - in Trump et al v .Boockvar et al. - Judge Matthew Brann granted the Defendants' Motion to Dismiss the First Amended Complaint and denied our Motion for Leave to File a Second Amended Complaint thus ending our case in the US Court for the Middle District. We will have more to say and do in this case later. However, I want to point out three things. First, I have tremendous respect and personal regard for Judge Brann. Second, however, contrary to the Judge's opinion, the Trump campaign is/was not asking, "this Court to disenfranchise almost seven million voters" (i.e. all 6.8 million Pennsylvania voters). In fact, my co-counsel, Rudy Giuliani, explained to the Judge and on the record, "We are NOT asking the Court to invalidate 6.8 million votes, only those votes cast without poll watchers being able to observe and those that were illegally cured." (my notes from oral argument). Third, I am disappointed the Judge did not grant us leave to file our Second Amended Complaint, which is the complaint that Scaringi Law worked on. The Judge wrote that to grant us leave to amend would cause "undue delay." However, the Safe Harbor deadline to certify presidential electors is December 8, 2020 - not November 23, 2020. So there is more time than it appears the Judge considered or believed. In any event, thank you to all who have expressed your support in our effort to ensure a free, fair and equal election.
